Terms of providing electronic services

Provision of Electronic Services

  1. The Invest Cuffs Foundation – Education and Development of Financial Markets, with its registered office in Kraków, ul. Mogilska 65, 4th floor, 31-545 Kraków, entered in the register of associations, other social and professional organizations, foundations and independent public healthcare institutions, as well as in the register of entrepreneurs maintained by the District Court for Kraków–Śródmieście, 11th Commercial Division of the National Court Register, under number 000586251, holding NIP 6793118922 and REGON 363021104, is a provider of electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344, as amended).
  2. These Rules constitute the regulations for the provision of electronic services within the meaning of Article 8 of the Act on the provision of electronic services.
  3. The Service Provider makes available to Users a service consisting of the use of functionalities provided within the Invest Cuffs Service.
  4. In order to cooperate with the IT system used by the Service Provider, the User must have equipment and a system meeting the following technical requirements:
    • a computer with a web browser with cookies and JavaScript enabled and access to the Internet,
    • a properly configured mobile device with cookies and JavaScript enabled and access to mobile data transmission and a cellular network.
  5. The Service Provider reserves that the use of services specified in these Rules may involve standard risks associated with the use of the Internet and recommends that Users take appropriate steps to minimize such risks. The Service Provider ensures the operation of an ICT system enabling the use of electronic services in a manner preventing unauthorized access to the content of the service, in particular through the use of cryptographic techniques appropriate to the nature of the service, as well as unambiguous identification of the parties to the electronic service. In the event of planned interruptions, upgrades or similar situations, the Service Provider has the right to notify Users via the provided e-mail address or generally on the website.
  6. The User’s consent to use the services covered by these Rules may be withdrawn at any time. Termination of the agreement for the provision of electronic services under these Rules is effected upon the User’s request for deletion of their data. Within 14 days of receiving the User’s request, the Service Provider deletes the User’s Personal Data from its database, provided such data has been stored.
  7. In matters not regulated in these Rules regarding the provision of electronic services, generally applicable provisions of law shall apply, in particular the Act on the provision of electronic services.

Functionalities of the Invest Cuffs Service

  1. The following functionalities are available within the Service:
    • the ability to obtain information about the scope of activity and services provided by the Service Provider;
    • the ability to order a free E-mail Notification Service consisting of the delivery of a specially prepared set of information for Users regarding services and products offered by entities from the financial services market (including investment services), luxury goods, automotive, real estate, education and IT technologies, sent to the User’s indicated e-mail address;
    • the ability to register participation in events organized by the Service Provider;
    • the ability to vote in a competition organized by the Service Provider.
  2. In order to use the E-mail Notification Service, the User must enter their e-mail address in the registration form and select the checkbox containing the declaration: “I wish to receive free E-mail Notifications constituting a set of information on services and products prepared by the Invest Cuffs Service and offered by entities from the financial services market (including investment services), luxury goods, automotive, real estate, education and IT technologies. I have been given the opportunity to familiarize myself with the rules for the provision of electronic services https://investcuffs.pl/zasady-swiadczenia-uslug-droga-elektroniczna.”
  3. For the avoidance of doubt, the Service Provider informs that the E-mail Notification Service constitutes ordered commercial information within the meaning of Article 10(2) of the Act on the provision of electronic services.
  4. The User may resign from the E-mail Notification Service at any time by sending an e-mail with the subject “Unsubscribe” to kontakt@investcuffs.pl.

Complaints

  1. The following rules apply to complaints regarding electronic services.
  2. Users of the Invest Cuffs Service have the right to submit complaints regarding services available through the Service. Complaints may be submitted in writing to the Service Provider’s address: Invest Cuffs Foundation – Education and Development of Financial Markets, ul. Mogilska 65, 4th floor, 31-545 Kraków, with a note indicating that the complaint concerns the “Invest Cuffs Service”, or by e-mail to administrator@investcuffs.pl.
  3. A complaint should include:
    • the name and surname of the complainant;
    • the complainant’s residential address and e-mail address;
    • a detailed description of the event forming the basis of the complaint;
    • an indication of the complainant’s demands.
  4. Complaints may be submitted within 60 (sixty) days from the date of occurrence of the event forming the basis of the complaint. For complaints submitted by post, the date of the postal stamp on the envelope is decisive, and for complaints submitted by e-mail – the date of sending the complaint.
  5. The Service Provider shall not consider complaints if the complainant has failed to meet the requirements referred to in section 3 or has not observed the deadline referred to in section 4 above.
  6. The Service Provider shall consider complaints within 30 (thirty) calendar days from the date of receipt of the complaint. After completion of the complaint procedure, the User has the right to pursue any unresolved claims before a common court having jurisdiction over the Service Provider’s registered office.
  7. The Service Provider is responsible for the course of the complaint procedure.
